This Acceptable Use Policy ("AUP") outlines the rules for using UpBuilder, operated by Deuslink Software LLC ("Company", "we", "us").

By using UpBuilder, you agree to comply with this policy. Violation may result in suspension or termination of your account.

Zero Tolerance: Child exploitation content (CSAM), terrorism, and credible threats of violence result in immediate account termination and law enforcement referral.


1. Permitted Uses

You may use UpBuilder for:

  • Converting Figma designs to code for legitimate purposes
  • Creating websites and web applications for yourself or clients
  • Client work, freelance projects, and agency work
  • Educational and learning purposes
  • Evaluation and testing of our services
  • Internal business tools and applications
  • Commercial projects within your subscription limits

2. General Prohibitions

You agree NOT to use UpBuilder to:

2.1 Illegal Activities

  • Violate any applicable laws, regulations, or legal requirements
  • Infringe on intellectual property rights of others
  • Violate privacy rights or data protection laws
  • Facilitate illegal transactions or money laundering
  • Evade sanctions or export controls

2.2 Security Violations

  • Attempt to hack, breach, or compromise our systems
  • Reverse engineer, decompile, or disassemble our software or AI models
  • Distribute malware, viruses, or malicious code
  • Interfere with network security or system integrity
  • Attempt to gain unauthorized access to accounts, systems, or data
  • Probe, scan, or test vulnerabilities without authorization
  • Conduct denial-of-service attacks

2.3 Data Collection Abuse

  • Use automated scripts, bots, or scrapers without permission
  • Harvest user information or content without authorization
  • Circumvent rate limits, quotas, or access controls
  • Create fake or duplicate accounts to evade limits
  • Share account credentials for unauthorized access

2.4 Harassment and Abuse

  • Bully, defame, disparage, or threaten others
  • Post or share content that harasses or intimidates
  • Engage in stalking or unwanted contact
  • Impersonate others or misrepresent your identity
  • Dox or publish private information about others

2.5 Spam and Deception

  • Send unsolicited advertising or promotional content
  • Engage in phishing or social engineering attacks
  • Create fake accounts or misrepresent affiliations
  • Manipulate reviews, ratings, or feedback systems
  • Use the service for fraudulent purposes

3. AI and Code-Specific Prohibitions

When using UpBuilder's AI features, you agree NOT to:

3.1 Harmful Content Generation

  • Generate code designed to harm users or systems
  • Create malware, spyware, or malicious scripts
  • Produce code for phishing or credential theft
  • Generate content that exploits vulnerabilities

3.2 Deceptive Practices

  • Misrepresent AI-generated code as entirely human-created when disclosure is legally required
  • Use generated code to create deceptive or fraudulent websites
  • Generate content designed to manipulate or deceive users
  • Create fake reviews, testimonials, or endorsements

3.3 Intellectual Property Violations

  • Generate code that knowingly infringes copyrights
  • Use the service to circumvent DRM or copy protection
  • Create counterfeit or knock-off websites
  • Violate trademark rights through generated content

3.4 AI Model Abuse

  • Attempt to extract, copy, or reverse-engineer our AI models
  • Use the service to train competing AI models
  • Probe the AI to discover training data or model weights
  • Submit inputs designed to cause harmful outputs

3.5 Surveillance and Privacy Violations

  • Generate code for unauthorized surveillance
  • Create tools for tracking individuals without consent
  • Build applications for biometric identification without proper authorization
  • Develop tools that violate privacy laws

4. Content Restrictions

You must not upload, process, or generate content that:

4.1 Illegal Content

  • Child sexual abuse material (CSAM) - zero tolerance, immediate law enforcement referral
  • Content promoting terrorism or violent extremism
  • Content facilitating human trafficking
  • Illegal weapons or controlled substances

4.2 Harmful Content

  • Promotes violence, self-harm, or suicide
  • Contains hate speech or promotes discrimination
  • Glorifies or incites violence against any group
  • Contains credible threats against individuals

4.3 Adult Content

  • Sexually explicit material
  • Non-consensual intimate imagery
  • Content sexualizing minors (even fictional)

4.4 Deceptive Content

  • Misinformation designed to cause public harm
  • Deepfakes or synthetic media intended to deceive
  • Impersonation of real individuals without consent

4.5 Infringing Content

  • Copyrighted material you don't have rights to use
  • Trademarked content used without authorization
  • Stolen or misappropriated designs

5. Usage Limits and Fair Use

5.1 Subscription Limits

Each subscription tier has specific limits on:

  • Number of design conversions
  • Number of connected projects
  • API call volume
  • Storage capacity

Exceeding these limits may result in service throttling, temporary suspension, or upgrade requirements.

5.2 Rate Limits

To ensure fair access for all users, we enforce:

  • API request rate limits
  • Concurrent conversion limits
  • Daily/monthly usage caps based on your plan

5.3 Prohibited Circumvention

You may NOT:

  • Create multiple accounts to circumvent limits
  • Use automation to exceed fair use
  • Share accounts to bypass user limits
  • Use technical means to evade rate limiting

6. Third-Party Platform Compliance

6.1 Figma Terms

When using our Figma integration, you must comply with:

  • Figma's Terms of Service
  • Figma's Acceptable Use Policy
  • Figma's Developer Terms

6.2 Webflow Terms

When using our Webflow integration, you must comply with:

  • Webflow's Terms of Service
  • Webflow's Acceptable Use Policy
  • Webflow's Developer Terms

6.3 Your Responsibility

You are responsible for ensuring your use of connected platforms complies with their respective terms. Violations of third-party terms may result in termination of your UpBuilder access.


7. Enforcement

Violation of this Acceptable Use Policy may result in:

7.1 Progressive Actions

  1. Warning: Written notice of violation with opportunity to cure
  2. Temporary Suspension: Account suspended pending review
  3. Permanent Termination: Account terminated without refund
  4. Content Removal: Violating content removed from our systems

7.2 Immediate Action (Severe Violations)

For severe violations, we may take immediate action without warning:

  • CSAM or child exploitation content
  • Credible threats of violence
  • Active security attacks
  • Clear illegal activity

7.3 Additional Measures

We may also:

  • Report illegal activity to law enforcement
  • Cooperate with legal investigations
  • Pursue legal action to recover damages
  • Share violation information with affected third parties

7.4 No Refunds

If your account is terminated for policy violations, you are not entitled to refunds for prepaid subscription fees.


8. Reporting Violations

If you become aware of any violation of this policy:

  • Include: Description of violation, evidence if available, affected parties

8.2 Anonymous Reporting

You may report violations anonymously. However, providing contact information helps us follow up if needed.

8.3 Our Response

We take all reports seriously and will:

  • Acknowledge receipt within 2 business days
  • Investigate promptly
  • Take appropriate action based on findings
  • Follow up with reporter if contact information provided

8.4 No Retaliation

We prohibit retaliation against good-faith reporters of policy violations.


9. Changes to This Policy

We reserve the right to modify this Acceptable Use Policy at any time.

9.1 Notification

We will notify users of material changes by:

  • Posting the updated policy on our website
  • Sending email notification for significant changes
  • Updating the "Last Updated" date

9.2 Continued Use

Continued use of our services after changes constitutes acceptance of the modified policy.
